Cobbs Agreement Definition
Cobbs agreements are unique to Michigan based on People v Cobbs, 443 Mich 276 (1993). While it is possible to receive a Cobbs agreement on any criminal charge, not every judge will give a Cobbs agreement. Some judges do not offer Cobb’s Agreements, and others permit them, but in minimal forms (such as a Cobb’s Agreement to sentence the defendant within the sentencing guidelines). In a Cobbs Agreement, a judge is asked to advise the defendant, before they plead guilty, the maximum sentence that might be imposed at the sentencing hearing.
