Burden of Proof Definition

The burden of proof refers to the persuasive value of evidence a party must offer to prove its allegations in court. In most civil cases, the burden of proof is a preponderance of evidence (greater than 50% proof). For a criminal conviction, the government’s burden of proof is beyond a reasonable doubt. Other burdens of proof include clear and convincing evidence and probable cause.
