Probation Violation Definition
An allegation that someone on probation violated a term or condition of the court’s order of probation. A person accused of probation violation has a right to a hearing, and the prosecutor must prove the defendant’s guilt by a proven by a preponderance of the evidence (meaning more likely to have violated probation than not). The maximum sentence for a probation violation is the same as the original charge.
