Target Letter Definition

The Department of Justice’s (DOJ) ordinary practice is to warn people under investigation for complex crimes that charges will likely be forthcoming. The DOJ provides this notice through official correspondence known as a “target letter.” The “target letter” is a document issued by federal prosecutors in the United States Attorney’s Office to a person invited to testify before a grand jury as a witness and likely to be charged with a federal crime related to that testimony. Most targets (people under investigation) decline to testify and assert their right to remain silent under the 5th Amendment.
