Habeas Corpus Definition

Habeas Corpus is a court order requiring a person in custody to be brought before a judge, especially to secure the person’s release if they are being held unlawfully. The purpose of a writ of habeas corpus is to demonstrate that a particular court’s decision to imprison a person was based on factual or legal error.
