The Killebrew Agreement is an agreement between the prosecutor and the defense attorney for a specific sentence on a felony or misdemeanor. The plea deal is presented to the sentencing judge. If the judge declines to follow the Killebrew Agreement, the defendant has a right to withdraw their plea and pursue a trial or renegotiate a new deal.
