Motion for a New Trial Definition
A Motion for New Trial is a request to have a jury verdict or a judge’s decision overturned and a new trial ordered by a court. A defendant is precluded from arguing lack of evidence as grounds on appeal if they did not first seek a new trial. A Motion for New Trial must be filed within 21 days of sentencing. A delayed Motion for New Trial can be filed but only within certain time limitations.
