Motion Definition
A written or oral request of a judge to make a legal ruling. The Michigan Court Rules have specific guidelines that govern how a motion must be drafted, when it must be filed, and what it has to include. After a motion is filed, the opposing party typically files a response. The original movant may file a reply to the response in most cases. Judges can issue a written ruling without oral arguments but usually require the parties to appear and orally argue their positions.
