Appellant Definition

When a party to a legal matter believes a legal error occurred in their case, they can seek review by a higher court. The process of taking an issue to a higher court is called an appeal. In a criminal case, the parties eligible to seek appellate review include the prosecution and the defendant. The party seeking appellate review and initiating the appeal is the “appellant.”
